This Site is developed, maintained and operated by Wyldsson Ltd. trading as “EarthChimp” ("EarthChimp"). We are registered as a Limited Company in the Republic of Ireland.

Collecting Personal Information

When you visit the Site, we collect certain information about your device, your interaction with the Site, and information necessary to process your purchases. We may also collect additional information if you contact us for customer support. In this Privacy Policy, we refer to any information about an identifiable individual (including the information below) as “Personal Information”. - Disclosure for a business purpose: shared with our processor Shopify
- Personal Information collected: version of web browser, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with the Site.
Order information
- Purpose of collection: to provide products or services to you to fulfill our contract, to process your payment information, arrange for shipping, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
- Source of collection: collected from you.
- Disclosure for a business purpose: shared with our processor Shopify, Stripe. Paypal, Amazon FBA.
- Personal Information collected: name, billing address, shipping address, payment information (including credit card numbers, email address, and phone number.

Identifiers, including certain data defined as “personal information” in the California Customer Records law or as a protected classification under California or federal law. This data includes:
Personal Contact Data: Any data you provide to Us that would allow Us to contact you, such as your name, postal address, e-mail address, social network details, or phone number.
Account Login Data: Any data that is required to give you access to your specific account profile. Examples include your login ID/email address, screen name, password in unrecoverable form, and/or security question and answer.
Certain Data from Your Computer/Mobile Device: Data about the computer system or other technological device that you use to access one of our websites or apps, such as the Internet protocol (IP) address used to connect your computer or device to the Internet and other online identifiers. If you access a Garden of Life website or app via a mobile device such as a smartphone, the collected data will also include, where permitted, your phone’s unique device ID, advertising ID, and other similar mobile device data.
Payment and Financial Data: Any data that We need in order to fulfil an order, or that you use to make a purchase, such as your debit or credit card details (cardholder name, card number, expiration date, etc.) or other forms of payment (if such are made available). In any case, We or our payment processing provider(s) handle payment and financial data in a manner compliant with applicable laws, regulations and security standards such as PCI DSS.
Demographic Data & Interests: Any data that describes your demographic or behavioural characteristics. Examples include your date of birth, age or age range, gender, geographic location (e.g., ZIP code), favorite products, hobbies and interests, and household or lifestyle data. This may include data about your health, medical conditions, nutrition, and exercise habits and goals. It may include data about your children’s genders, feeding styles, birthdates, or expected due dates. It may also include data about work status or professional credentials. In some cases, this could include data that you give Us about someone else. For example, if you provide a friend’s email address for a tell-a-friend program. It may also include data about your pets and pet preferences. If you are a health care professional, We may collect data about your practice.
Third-Party Social Network Data: Any data that you share publicly on a third-party social network or data that is part of your profile on a third-party social network (such as Facebook) and that you allow the third-party social network to share with Us. Examples include your basic account data (e.g., name, email address, gender, birthday, current city, profile picture, user ID, list of friends, etc.) and any other additional data or activities that you permit the third-party social network to share. We receive your third-party social network profile data (or parts of it) every time you download or interact with a Garden of Life web application on a third-party social network such as Facebook, every time you use a social networking feature that is integrated within a Garden of Life site (such as Facebook Connect) or every time you interact with Us through a third-party social network. We use this data for a number of purposes, such as (1) consumer service purposes, including responding to your inquiries; (2) to provide you with information about goods or services; (3) personalization, such as to analyse your preferences and habits, anticipate your needs, improve and personalise your experience on our websites and apps, provide you with targeted advertising and content, and allow you to participate in interactive features; (4) order fulfilment; and (5) other general business purposes, such as internal or market research, analytics, and security.

Minors

The Site is not intended for individuals under the age of 13. We do not intentionally collect Personal Information from children. If you are the parent or guardian and believe your child has provided us with Personal Information, please contact us at the address above to request deletion.

For example, We remember your login ID/email address or screen name so that you can quickly login the next time you visit our site or so that you can easily retrieve the items you previously placed in your shopping cart. Based on this type of information, and with your consent (where required), We also show you specific Garden of Life content, promotions or other opportunities that are tailored to your interests.
Order fulfilment. We use your personal data to process and ship your orders, inform you about the status of your orders, correct addresses and conduct identity verification and other fraud detection activities. This involves the use of certain personal data and payment information.
Abandoned cart. We use cookies to help keep track of the items you put into your cart, including when you have abandoned your cart, and use this information to determine when to send a cart reminder via SMS or other channel.
Other general purposes (e.g. internal or market research, analytics, security). In accordance with applicable laws, We use your personal data for other general business purposes, such as maintaining your account, conducting internal or market research and measuring the effectiveness of advertising campaigns. We reserve the right, if you have Garden of Life accounts, to reconcile those accounts into one single account. We also use your personal data for management and operation of our communications, IT, and security systems.

Service providers. We share data with our service providers. These are external companies that We use to help Us run our business (e.g., order fulfilment, payment processing, fraud detection and identity verification, website operation, market research companies, support services, promotions, website development, data analysis, CRC, etc.).
Third party companies using personal data for their own purposes. We may share data with third parties, which they may use for their own purposes. This may include their own marketing purposes. They may send or provide you with offers for products or services that may interest you. We may also permit third parties to collect data about you on our websites or apps for their own purposes.

DATA PROTECTION AND RETENTION

We use reasonable and appropriate security measures as required by applicable law. The transmission of information via the Internet is, unfortunately, not completely secure and despite our efforts to protect your personal data, We cannot guarantee the security of the data during transmission through our websites/apps. It is important that you also play a role in keeping your personal data safe and secure. When signing up for an online account, please be sure to choose an account password that would be difficult for others to guess and never reveal your password to anyone else. You are responsible for keeping this password confidential and for any use of your account. If you use a shared or public computer, never choose to have your login ID/email address or password remembered and make sure to log out of your account every time you leave the computer. You should also make use of any privacy settings or controls We provide you in our websites/apps.
How Long We Keep Your Data We retain personal data only as long as necessary for the purposes described in this policy:
- Order data (name, address, items, payment confirmation): retained for 7 years to meet tax and accounting obligations under Irish and EU law, then deleted.
- Email marketing data (email address, preferences, engagement): retained until you unsubscribe or request deletion.
- Website analytics: retained per cookie durations listed below (30 minutes to 2 years).
- Customer service correspondence: retained 3 years from last contact.
- Amazon marketplace data (where you ordered via Amazon and we received fulfillment information): retained per Amazon's Data Protection Policy — buyer-identifying fields are retained for less than 30 days post-shipment in our internal systems.
You may request earlier deletion at any time, subject to our legal obligations to retain certain records.

Sharing Personal Information

We share your Personal Information with service providers to help us provide our services and fulfill our contracts with you, as described above. For example:

We may share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

International Data Transfers
EarthChimp is operated by Wyldsson Ltd., headquartered in Ireland (EU). Some of our service providers are located outside the European Economic Area, including in the United States and Singapore. When we transfer your personal data outside the EEA, we rely on the following safeguards:

Standard Contractual Clauses (SCCs) approved by the European Commission, signed with each non-EEA processor (including Shopify, Klaviyo, Supabase, Amazon Web Services, Google, Meta).

Adequacy decisions where applicable (e.g. UK after Brexit).

Supplementary measures including encryption in transit (TLS 1.2+) and at rest (AES-256), and access controls limited to named personnel.

Behavioural Advertising

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. For example:

We use Shopify Audiences to help us show ads on other websites with our advertising partners to buyers who made purchases with other Shopify merchants and who may also be interested in what we have to offer. We also share information about your use of the Site, your purchases, and the email address associated with your purchases with Shopify Audiences, through which other Shopify merchants may make offers you may be interested in.
We use advertising tools from Meta and Google.

Data Breach Notification

If we become aware of a breach of personal data that we control, we will notify affected users and the relevant supervisory authorities (Data Protection Commission in Ireland for GDPR; Attorney General in California for CCPA) within 72 hours of confirmation, in accordance with GDPR Article 33 and applicable US state law. Notifications will include the nature of the breach, categories of data affected, likely consequences, and steps we are taking to address it.
